Update May 2026 – DA appeal thwarted
In an important win for the environment, the Land & Environment Court (LEC) has upheld Port Stephens Council’s refusal for a proposed tourist accommodation park at 1107 Swan Bay Road, protecting the vital habitat of the critically endangered Far Eastern Curlew along with other vulnerable and threatened migratory birds. The Hunter Bird Observers Club (HBOC), with the support of EcoNetwork Port Stephens and the National
Parks Association of NSW (Hunter Branch), wish to raise serious concerns regarding the impact of the
above development proposal on wetland habitat at Cockle Shell Point, Swan Bay. Our organisations
together represent over 700 individuals across the Hunter region, and about 30 local community groups and businesses within the Port Stephens district.

The Hunter Bird Observers Club recommends that the proposed development should not be permitted to proceed.
